Join Zoom Meeting: https://us02web.zoom.us/j/84913916486?pwd=KzQwbE9NKzYvdWZlOTJ0ZGdnUEkvQT09

Meeting ID: 849 1391 6486; Passcode: 450561

Agenda:

The Constitutional Amendment, approved by voters on 11/3/20, to legalize cannabis for adults in New Jersey took effect on 1/1/21. Per the ballot question’s Interpretive Statement: “The Cannabis Regulatory Commission (will) oversee the new adult cannabis market…The scope of the commission’s new authority (will) be detailed in laws enacted by the Legislature.”

Legislation to enact this amendment passed in the Legislature on 12/17/20: S21/A21: Cannabis Regulatory, Enforcement Assistance, & Marketplace Modernization Act and, S2535/A1897: Decriminalization.

CMMNJ submitted recommendations for the implementation of New Jersey’s adult-use cannabis. As 2020 ended, N.J.’s legal cannabis bill was held up at the final stage because Gov. Murphy wanted to clarify penalties for underage use.

NJ AG said prosecutors must stop low-level cases statewide, but possession arrests (up to 105/day) can continue in NJ. Call for pardons for New Jersians with marijuana convictions. The Cannabis Regulatory Commission still has only three of five members appointed.

MORE Act: On 12/4/20, the U.S. House of Representatives passed H.R. 3884, the Marijuana Opportunity Reinvestment and Expungement Act of 2020 (MORE Act.) This bill would decriminalize and deschedule cannabis, and provide for expungement of federal cannabis offenses. There are concerns about this bill. It must still pass in the U.S. Senate before going to the president’s desk.

Patients Out of Time has created a coalition of organizations and individuals to demand the end of federal cannabis prohibition with their Resolution to De-Schedule Cannabis. Please share.

A New Mexico judge ruled that medical marijuana patients cannot be punished for using cannabis while incarcerated.

POT Comes to NJ: May 10 -12, Jersey City

“Patients Out of Time” Conference Coming to New Jersey, May 10-12, 2018

Mary Lynn Mathre, RN, MSN, CARN, the President and Founding Director of “Patients Out of Time” (POT), a 501(c)(3) nonprofit educational organization, is bringing her highly regarded cannabis/marijuana conference to New Jersey this year. POT’s 12th national conference, “Cannabis: Alleviates Pain, Treats Addiction” will be held May 10 – 12, 2018 at Loews Movie Palace, 54 Journal Square Plaza, Jersey City, NJ. Registration information is available at: http://patientsoutoftime.org/the-twelfth-national-clinical-conference-on-cannabis-therapeutics/

The POT conference is an excellent way for physicians to earn CMEs and nurses and other healthcare professionals to earn contact hours (CEUs) for their continuing education requirements, while learning about the science that supports the use of marijuana/cannabis. POT conferences bring together some of the top marijuana researchers from across the country and from around the world.  Medical marijuana patients and activists are also represented at these conferences.

The theme of the conference, the use of marijuana in the treatment of pain and addiction, is particularly relevant to New Jersey this year.

In October 2017, the healthcare professionals in the Review Panel, appointed by the New Jersey Department of Health (DOH), recommended that 43 petitions be approved as additional qualifying conditions for marijuana therapy in the state’s Medicinal Marijuana Program (MMP). The majority of these petitions concerned chronic pain of various origins. One of the petitions recommended for approval would allow marijuana to be recommended for Opioid Use Disorder.

Governor Phil Murphy signed Executive Order #6 on January 23, 2018 directing the DOH and the Board of Medical Examiners to review the MMP within 60 days and make recommendations to expand it and ease access to it. See: http://nj.gov/infobank/eo/056murphy/pdf/EO-6.pdf

Governor Murphy announced at a press conference in Trenton on March 27, 2018 that the Commissioner of the DOH approved the recommendations of the Review Panel, along with other improvements to the MMP. For the full report on Executive Order 6, see:
http://www.state.nj.us/health/medicalmarijuana/documents/EO6Report_Final.pdf

The governor noted that “scientific studies demonstrate that the medical use of marijuana has proven to be an effective treatment for patients suffering from painful, debilitating, and often chronic medical conditions; (but) of New Jersey’s nine million residents, only approximately 15,000 are able to participate in the State’s MMP.” Expanding the MMP will “ensure that (patients) are receiving a product tailored to their medical needs, and make them less likely to turn to potentially more harmful and less medically appropriate drugs such as opioids, the use of which was declared a public health crisis.”

The governor said at the press conference, "For 8 years medical marijuana has been legal in New Jersey, but the law's spirit has been stifled by a hostile administration. We've had medical marijuana in name only."

Governor Murphy also campaigned to legalize marijuana for adult use in New Jersey. Marijuana use is poised to become a great deal more prevalent in New Jersey with the expansion of the medical program and the possibility of legalization for adults. It therefore is incumbent on healthcare professionals to have a greater understanding of the expected effects, side effects, adverse effects, dosages and drug interactions associated with the use of this substance.

Attending the Patients Out of Time national conference, “Cannabis: Alleviates Pain, Treats Addiction” is an excellent place to start, or continue, this educational process.

NJ panel OKs marijuana for more conditions

The Medicinal Marijuana Program Review Panel--five physicians, two pharmacists and one RN, who were appointed by the New Jersey Department of Health—gave their final approval on October 25th for the use of marijuana for a number of additional medical conditions.

Dr. Alex Bekker, MD, PhD, a professor and department chairman at Rutgers New Jersey Medical School, led the panel of medical experts that approved marijuana therapy for chronic pain, anxiety, migraines, and Tourette's syndrome.

About one third of all Americans suffer from chronic pain at sometime in their lives. Indeed, 32 of the 45 petitions that the panel reviewed were related to chronic pain. In approving marijuana therapy for pain, the panel relied on over 400 peer-reviewed journal articles to make their evidence-based decision. The National Academy of Sciences also endorsed medical marijuana for chronic pain when “conventional therapies fail.” The panel noted the many side effects, and possible severe adverse effects, of both prescription opiates and over-the-counter pain relievers. The panel acknowledged that there were significantly fewer opiate overdose deaths in states with robust medical marijuana programs.

The panel said that opiate addiction is a “public health emergency” in America, the day before President Trump formally declared this emergency. Marijuana has been shown to be an effective substitute for pharmaceutical pain relievers and can also help ease the withdrawal from opiate addiction.

One of the chronic pain petitions that the panel approved was MMP-063, “Opioid Use Disorder.” This petition was submitted by Vanessa Waltz, a Board Member of the Coalition for Medical Marijuana--New Jersey. In approving this condition to qualify for marijuana therapy in the state's program, the panel recognized that marijuana, far from being a “gateway” to harder drug use, is actually an “exit drug.” In 1999, the Institute of Medicine thoroughly repudiated the Gateway Theory saying, “There is no conclusive evidence that the drug effects of marijuana are causally linked to the subsequent abuse of other illicit drugs.” Even the Drug Enforcement Administration (DEA) acknowledged in the July 8, 2011 Federal Register that there was no “direct causal relationship between regular marijuana and other illicit drug use.” The reality is that marijuana can be an exit drug from addicting and dangerous prescription drugs, from street drugs like heroin, and even from alcohol addiction and overuse.

The panel also approved anxiety, both primary and secondary anxiety (related to Autism and Alzheimer’s disease). The panel noted that anxiety can be debilitating. When anxiety does require pharmaceutical intervention, most conventional treatment is unacceptable. The benzodiazepams, or minor tranquilizers, for example, are widely abused and withdrawal from them can be life-threatening. Anti-depressants are often prescribed for anxiety, but they are not effective for two to six weeks, and anxiety is not a depressive illness. The panel felt that there was a significant place for marijuana in fighting anxiety.

Also given final approval by the panel were migraine headaches and Tourette’s syndrome. The panel cited articles and research by Dr. Ethan Russo in support of marijuana for migraines. Dr. Russo is one of the leading authorities in medical marijuana in the United States. In approving marijuana for Tourette’s, the panel noted that there currently is no accepted nor effective pharmacologic treatment for the syndrome. Only major tranquilizers (anti-psychotic or neuroleptics drugs) are prescribed, but Tourette’s is not a psychotic disorder.

The panel only rejected two petitions, MMP-020 Asthma, and MMP-055 Chronic fatigue syndrome. The panel was not convinced that there was sufficient evidence presented in the petitions to support including these two conditions in New Jersey’s Medicinal Marijuana Program.

The panel should be congratulated for its research, its thoroughness and its courageous adherence to evidence-based criteria in its decision making. When the science is objectively pursued, the therapeutic potential of medical marijuana is found to be enormous.

Now the commissioner of the Department of Health has 180 days to decide what, if any, of the panel’s final recommendations to accept. In recognition of the now formally declared public health emergency that is the opiate epidemic in America, the commissioner must act speedily in adopting the final recommendations of the panel. Lives are at stake.

Indeed, the entire country should follow the final recommendations of the experts in New Jersey’s Medicinal Marijuana Program Review Panel.

Here's what the legal pot bill would do
Scutari's bill, (S3195) based on visits to Colorado's thriving recreational program would:
⦁ Decriminalize marijuana possession of up to 50 grams "immediately" and allow people who have been arrested for pot possession to expunge their records;
⦁ Establish a Division of Marijuana Enforcement in the state Attorney General's Office which would create the rules used to govern the legal market of growers and sellers;
⦁ Allow people to possess up to one ounce of dried marijuana, 16 ounces of edible products infused with cannabis, 72 ounces in liquid form and seven grams of marijuana "concentrate;
⦁ Impose a sales tax on recreational sales beginning at 7 percent in the first year, climbing to 10 percent in the second year and jumping five percent more each year until it reaches 25 percent. Taxes on medical marijuana would be abolished.
⦁ Give the five existing medical marijuana dispensary nonprofit groups first crack at selling recreational pot.
