Press Release: CMMNJ’s 20th Anniversary with New Board Members

CMMNJ’s 20th Anniversary with New Board Members

 For more information, contact: Ken (609) 394-2137

 FOR IMMEDIATE RELEASE

WHO:     The Coalition for Medical Marijuana--New Jersey, Inc. (CMMNJ)

WHAT:    Celebrates its 20th Anniversary with New Board Members

WHEN:   March 10, 2023

WHY:       There is still much work to do.

The Coalition for Medical Marijuana--New Jersey, Inc. (CMMNJ) celebrates the 20th anniversary of its first public appearance by welcoming three new members to its 11 member Board of Directors: Nichelle Santos and Jeff Booker, co-founders of CannaCoverage https://www.cannacoverage.net/, and Valisha Desir, Esq. https://www.linkedin.com/in/valisha-desir-esq-a62b6743/, a cannabis industry lawyer.

CMMNJ’s first public appearance was at the White Dog CafĂ© in Philadelphia on March 10, 2003. It was one of the final outreach efforts of Cheryl Miller, the wife of CMMNJ co-founder Jim Miller. Cheryl found that marijuana was the only drug that relieved her muscle spasms, and she was a tireless advocate for the right of patients to use marijuana therapeutically. Cheryl died of complications of multiple sclerosis (MS) on June 7, 2003.

CMMNJ was instrumental in getting the New Jersey Compassionate Use Medical Marijuana Act introduced into the legislature in 2005 and signed into law in 2010.

In 2014, CMMNJ endorsed, and began a successful campaign for the legalization of marijuana, calling it the best way to get this essential medicine to the most people.

The CMMNJ Board’s post-legalization goals for medical cannabis include:

  • insurance coverage;
  • home cultivation rights; and,
  • hospital & institutional access.

CMMNJ Zoom Meeting Agenda for August 9, 2022

CMMNJ Monthly Meeting Agenda for August 9, 2022 at 7 pm

Join Zoom Meeting:

Meeting ID: 830 6097 3936 Passcode: 513706

Agenda: The NJ Legislature will return from its summer break in September. CMMNJ’s post legalization goals include:

Medical Cannabis Insurance Bills:

  • S313/A3248: Costs of medical cannabis to be reimbursed by Catastrophic Illness in Children Relief Fund, PAAD, Senior Gold and VCCO. The bills passed Senate and Assembly Health Committees and were referred to the Senate Budget Committee and the Assembly Oversight Committee. OLS Fiscal Estimate is here.
  • S309: Requires workers' compensation, PIP, and health insurance coverage.
  • S782: Will subsidize medical cannabis in Medicaid or NJ Family Care.
Wolski said CMMNJ continues to push for “insurance coverage for medical patients…Insurance coverage would be a real game changer for patients. I mean, imagine paying a $15 co-pay for an ounce of marijuana," he said.

Home cultivation bills:

  • S342/A997: Authorizes home cultivation of medical cannabis.
  • A1422: Legalizes possession of six marijuana plants for personal use.
  • A3657/S353: Legalizes six plants for personal use and 10 plants for medical.

Institutional access now!

NJ Disabled American Veteran and marijuana reform activist Dan Brady died in a South Jersey nursing home on 7/22/22, unable to access the medical cannabis he was entitled to as a hospice patient. He suffered needlessly, as did his family and friends, as a result.

Psilocybin Legalization Bill:

NJ Senate President Files Psilocybin Legalization Bill; CMMNJ Board of Directors endorsed Bill S2934, Psilocybin Behavioral Health Access and Services Act.

National Issues:

On July 6, 2022, U.S. Sen. Cory Booker’s letter asked President Biden to end the federal ban on cannabis, and allow states to decide on legalizing the drug.

On 7/21/22, Sen. Booker introduced the Cannabis Administration and Opportunity Act (CAOA) to remove marijuana from the Controlled Substances Act entirely.

Senate Confirms Dr. Shareef Elnahal as VA undersecretary of health. @ShereefElnahal: Marijuana needs to be descheduled at the federal level. Patients on #MedicalMarijuana deserve better. We are stuck with:

  • Scant research funding
  • Limited to no access in hospitals/nursing homes
  • High costs for patients.

In a Gallup poll, a record 68% of Americans support legalizing cannabis, with 32% in opposition. (NJ’s numbers for the 11/20 ballot question to legalize cannabis—67% to 32%!)

The Cannabis Regulatory Commission (CRC):

CRC Meetings: July 28, Sept. 22, Oct. 20, and Dec. 8, all at 1 pm.

The CRC Issued 81 new licenses that include 22 for cultivators, 11 for manufacturers and 48 for retailers. Find an adult use dispensary in NJ.

Trichome Analytical, NJ’s first accredited cannabis and hemp testing lab, won the state’s first annual testing license, License #TL000001, in the adult-use program.

Five ATC’s fined $360K for selling to adult use customers during patient-only hours in NJ’s legal weed launch.

Ewing ATC, BLOC, opens with hopes of selling adult weed in the fall.

New Jersey labor unions are making real progress representing workers in legal cannabis sales.

Towns have the power to put justice in cannabis legalization — they must use it.

On July 1, NJ  state sales tax was eliminated for medical cannabis purchases. But municipalities may continue to charge a 2% tax on dispensary sales.

"Cannabis Administration and Opportunity Act" Comments

August 31, 2021

The Honorable Charles E. Schumer
Majority Leader
U.S. Senate

The Honorable Cory Booker
U.S. Senate

The Honorable Ron Wyden
U.S. Senate

RE:      Medical Provisions in the Cannabis Administration and Opportunity Act

Dear Leader Schumer and Senators Booker and Wyden:

Thank you for your continuing leadership on cannabis de-scheduling legalization, as well as on the social justice and equity reforms that play such a critical role in cannabis policy. As you know, cannabis reform is not just about the legalization and thoughtful regulation of marijuana, it’s about principles of American federalism and ensuring that our laboratories of democracy have the opportunity to help shape how cannabis should be regulated in the fifty states. There are currently three dozen state medical marijuana programs serving more than 3,500,000 patients in the United States, rapidly providing treatment plans designed to displace opioid prescriptions, and we are writing to ask for your help in protecting them.

Creating a Pathway for Medicinal Marijuana

While we were elated with much of the draft language in the Cannabis Administration and Opportunity Act, we believe that the bill misses the mark in some key areas by ignoring existing state medical marijuana programs and by failing to recognize state-level advances in medical marijuana. Congress must specifically and intentionally create a path to retain the medical cannabis industry that is critical to patients suffering from chronic pain, cancer, PTSD, depression, and other debilitating conditions.

Since the first state medical marijuana law was enacted in California in 1996, state governments have continuously demonstrated their competency for regulating the emerging medicinal cannabis marketplace. These states have tailored their regulatory regimes to ensure that they balance public health and safety, administrative feasibility, and business operability. Today, increasing numbers of physicians and other qualified providers in states with legal medicinal cannabis programs routinely recommend cannabis for qualifying conditions. Those qualifying conditions are state-specific and can include chronic pain, cancer, PTSD, end-of-life care, depression, anxiety, and other debilitating diseases.

We must specifically and intentionally retain these state medical programs currently serving millions of patients—offering arguably one of the most viable alternatives to opioids. We must also provide states with ample time to create their own medicinal markets, to build on advances in existing medical programs, and to harmonize state regulatory programs across the country, as is practicable. This must all be done deliberately and will take time to develop and implement. This will require a transition period prior to a national marketplace and intentional lawmaking by Congress.

Insurance Coverage

As a first priority, Congress should intentionally and specifically permit coverage by private insurance companies in the Cannabis Administration and Opportunity Act. Cigna already allows reimbursement for CBD products. While this should flow naturally from de-scheduling, an intentional and specific provision by Congress authorizing this pathway would stave off private litigation risks and Executive Branch overreach through regulation. Congress should also specifically provide for the allowance of HAS/FSA funds to be used for medicinal cannabis. These tax-deductible contributions are already currently being used on alternative care, including acupuncture, aromatherapy, ayurvedic medicine, homeopathy, nutritional counseling, and unregulated traditional Chinese medicine. These provisions are not currently contemplated in the Act, and will take time to promulgate, coordinate, and ultimately administer. Additionally, the industry should be permitted to make substantiated structure/function claims, without premarket review, notwithstanding the fact that cannabis may already be an ingredient in some pharmaceutical drugs. This policy should also be codified in federal law, rather than being left to FDA rulemaking.

Insurance Reimbursements

A successful transition to federal regulation must also support a clear pathway for insurance reimbursement for medical cannabis. The NIH/NIDA is currently funding a number of efforts to document and enable the successful treatment of patients with pain with cannabinoids in order to reduce their use/overuse of opioids. However, due to the lack of insurance reimbursements, nearly all of these costs are being absorbed by patients. Some states have noticed the pharmacoeconomic advantage that cannabis treatments can provide over existing therapies in specific indications, and their Medicaid programs are evaluating reimbursement for these situations. In addition, many workers compensation programs nationwide are taking similar steps. We therefore request that Congress specifically provide for the allowance of insurance reimbursements for medical marijuana patients in the Cannabis Administration and Opportunity Act.

Research

Notwithstanding housing the best medical research institutions in the world, Cannabis research in the U.S. severely lags behind other nations. While convincing research on cannabis safety and therapeutic utility of medical cannabis products is being generated in Europe and Israel, federal prohibition in this country obstructs open research into the science of cannabis therapeutics for products that do not have an approved IND, despite millions of Americans currently buying and using medical cannabis routinely. The president has indicated that he would like to see more research, so let’s give it to him. Let’s unleash American scientists and doctors to evaluate and document the myriad benefits of cannabis. This research will take time to get right and we should get this done prior to unleashing interstate commerce.

The Act mandates the comptroller general to issue a report on the societal impact of cannabis legislation within two years after the enactment of this Act. Congress has also provided a mandate to HHS to issue a report related to the public health effects of cannabis with an end-date of 2025. And Congress mandated that the secretary of transportation collect data on highway safety. The research objectives in the bill are critical to protecting public health and safety and will take time to get right.

For the foregoing reasons, we request that Congress incorporate insurance coverage and reimbursements into legislation and allow for a transition period prior to unleashing interstate commerce and imports. This will support medicinal marijuana programs currently serving millions of patients at the state level, and will ensure that we complete research and implement national standards to protect public health and safety.

Sincerely,

CMMNJ Year End Report 2020

The Coalition for Medical Marijuana New Jersey, Inc. (CMMNJ) is a non-profit educational organization incorporated in the State of New Jersey and recognized by the federal government as a 501(c)(3) public charity. The mission of CMMNJ is to educate the public about medical marijuana.  The goal of CMMNJ is to have safe and legal access to medical marijuana for New Jersey patients. March 10, 2020 was the 17th anniversary of the founding of CMMNJ.

CMMNJ’s public meetings for 2021 will continue to be held on the second Tuesday of each month from 7 - 9 pm via Zoom until further notice. All are welcome at these meetings and there is never a charge to attend.

New Jersey Highlights of 2020

Voters agreed to legalize cannabis in New Jersey. The Final Election Results from November 3, 2020 on Question 1, a constitutional amendment to legalize cannabis for personal, non-medical use by adults who are age 21 years or older, subject to regulation by Cannabis Regulatory Commission, effective 1/1/21:

YES - 2,737,682 (67.08%)

NO - 1,343,610 (32.92%)

(As of 12/8/20 with 6,348 of 6,348 Precincts Reporting - 100%)

Home Cultivation: Visit the website: Let Patients Grow NJ #JeffsLaw.  Sign the petition for Home cultivation for patients: Let Patients Grow NJ.

The Medical Marijuana Program continues to expand with the Murphy administration, but additional ATCs are held up by legal challenges, and the 2019 Jake Honig law has yet to be fully implemented.

Marijuana reform made progress nationally and regionally.

CMMNJ supports Patients Out of Time’s coalition to deschedule cannabis.

Cannabis legalization

In 2014, CMMNJ’s Board of Directors endorsed legalization of marijuana since legalization is the best way to get this essential medicine to the most people. Legalization is also an important step in undoing the harms to society that are caused by our current policy of drug prohibition.

The New Jersey Legislature was unable to pass a marijuana legalization bill in 2019. Instead, cannabis legalization in NJ would be decided by a ballot question on November 3, 2020. The Constitutional Amendment that appeared on the ballot, SCR183/ACR840, passed in the Senate (24-16) and in the Assembly (49-24-1) on 12/16/2019, after Senate and Assembly hearings on 12/12/19.

By March 2020, CMMNJ started a “Get Out the Vote” (GOTV) campaign. CMMNJ joined with HeadCount’s Cannabis Voter Project  and urged residents to text CANNA to 40649 or text WEVOTE to 40649. We urged residents to plant the seeds of change and #growyourpower; and to talk to elected officials about cannabis reform.

In April, CMMNJ began sending letters to all NJ colleges and universities in the state as part of our Get Out the Vote campaign.  We asked higher education administrators for their support in our efforts. It was a challenging time because no one knew for sure if there would even be students on campus in the fall. Nevertheless, we got some encouraging replies from various academic administration members. CMMNJ volunteer Dee Carnegia forwarded CMMNJ’s letter, GOTV at Princeton U, to about 50 NJ colleges and universities and she kept track of our efforts and followed up with emails and telephone contacts where appropriate. Another CMMNJ volunteer, Tracey McHugh, reached out to fraternities and sororities in the state with the same GOTV message.

An April poll showed 61% of NJ voters say they will approve the Constitutional amendment to legalize cannabis for adults. CMMNJ redoubled its efforts, believing that we should proceed as if we are behind in the polls and need to improve our standing. A later poll showed 68 percent of NJ respondents support legalizing cannabis for adults.

Cannabis Decriminalization bill A1897 passed in the NJ Assembly 6/18/20.

Due to the pandemic, Gov. Phil Murphy ordered millions of ballots to be mailed to voters by Oct. 5.  The state provided more ballot drop boxes. To count, ballots had to be postmarked by Nov. 3 and arrive no later than 8 PM a week after Election Day.

NJ.Com: Campaign to legalize marijuana kicks off with 55 days until election

In June, “NJ CAN 2020” joined the effort to approve the ballot question. NJ CAN 2020 had an experienced campaign manager, Axel Owen, who worked with CMMNJ closely. NJ CAN 2020 members included the ACLU NJ, the NAACP NJ, Doctors for Cannabis Regulation, NJ United for Marijuana Reform, the Latino Action Network, the American Trade Association for Cannabis and Hemp, Law Enforcement Action Partnership, & the NJ CannaBusiness Association. See NJ CAN 2020 30-second ad: Vote YES to Legalize Cannabis in New Jersey!

Join Gov. Phil Murphy in the fight to legalize adult-use marijuana. Rick Steves helped with: It’s Time to Legalize Marijuana in New Jersey. Robert Platshorn supported the legalization effort with his video The Silver Tour.

CMMNJ held a Poster Contest to inspire people to vote YES on November 3rd. CMMNJ’s Poster Contest winner is the logo by Jo Anne Zito. Yard signs that were made with variations on this design were available from CMMNJ by October 9, 2020. Many volunteers helped to pay for and distribute the yard signs.

Marijuana legalization won in all 21 counties in New Jersey, with approval rates from 75% in Camden County to 60% in Ocean County.  The Constitutional Amendment takes effect on 1/1/21. Per the ballot question’s Interpretive Statement: “The Cannabis Regulatory Commission (will) oversee the new adult cannabis market…The scope of the commission’s new authority (will) be detailed in laws enacted by the Legislature.” More info at: SCR183/ACR840.

Many thanks to the friends, family, colleagues, advocates, organizations, patients, and voters who made the victory for cannabis legalization possible. It was not just an election victory; it was a thorough repudiation of the war on marijuana in every county in New Jersey! CMMNJ said that our state is now on track to become healthier, wealthier, and safer!

On November 6th, Gov. Murphy Announced Cannabis Regulatory Commission Appointments: Dianna Houenou, Chair, & Jeff Brown, Executive Director.

CMMNJ’s Adult-use Cannabis Recommendations were distributed:

However, as 2020 ended, N.J.’s legal cannabis bill was held up again at the final stage because Gov. Murphy wanted to clarify penalties for underage use.

HOME GROW

In January 2020, Jo Anne Zito published the Op Ed: Allow home cultivation of medical marijuana. See Facebook: #THEYSHALLGROW

Jo Anne and Jim Miller worked diligently for a home cultivation program for NJ MMP patients. They encouraged people to sign the petition: Let Patients Grow NJ. By March, about 800 had signed. The petition urged legislators to meet with CMMNJ to discuss patient concerns. Governor Murphy said he’d sign a Home Grow bill (Jeff’s Law) if we got it to his desk, but the bill still needs to be written and introduced.

Also, CMMNJ encouraged visits to the website: Let Patients Grow NJ #JeffsLaw. We asked supporters to establish contact with NJ legislators and create an email trail and post it. In October, Jo Anne published another Op Ed: A few cannabis plants to love at home | Zito

New Jersey Department of Health Medicinal Marijuana Program (MMP)

The eighth anniversary of legal sales of marijuana in New Jersey was on 12-6-20. The tenth anniversary of New Jersey’s Compassionate Use Medical Marijuana Act becoming law was on 1-18-20.

In 2020, Alternative Treatment Centers (ATCs) serving medical marijuana were designated “essential services” by the State of New Jersey and allowed to continue operating during the pandemic. The Department of Health (DOH) allowed ATCs to offer curbside pickup to patients. Caregiver fees are reduced to $20. However, patients still saw long lines at ATCs, reduced availability of specific strains, and temporary ATC closings.  In May, Jeff Brown said, “More can be done.”

There are thirteen ATCs currently dispensing medical marijuana at the end of 2020 (9 ATCs & 3 satellites) to serve over 80,000 patients.

Columbia Care in Vineland,

Ascend Wellness, (formerly Greenleaf) in Montclair,

The Botanist (Compassionate Care Foundation) Egg Harbor & Atlantic City,

Garden State Dispensary in Woodbridge, Eatontown, and Union Township,

Breakwater in Cranbury,

Curaleaf in Bellmawr,

Harmony in Secaucus,

Rise in Paterson,

Zen Leaf in Elizabeth,

Apothecarium in Phillipsburg, NJ opened in November 2020.

In August 2020, New Jersey state officials allowed providers to remotely prescribe medical marijuana during the coronavirus pandemic using telemedicine.

The  DOH changed and reissued the RFA for 24 new ATCs in NJ on 7/1/19, including up to 8 in the north, 8 in central NJ, 7 in the south, and 1 “at-large”; these include 5 for cultivation, 15 dispensaries, and 4 vertically integrated permits. Application forms were posted July 15; due on 8/21 (Dispensary) and 8/22 (Cultivation & Vertically Integrated). An NJ appellate court agreed to halt the review of 196 applications for 24 medical marijuana licenses. The DOH said 51 applications were disqualified for various reasons, but applicants are appealing that decision. The Appellate court on 7/2/20 denied the DOH motion to end the stay and award ATC licenses. The DOH defended its actions, saying it was for good reasons that certain applicants were rejected on November 18, 2019. (Awards were supposed to be announced in December.) This continues to halt the progress, over a year later, of 24 additional NJ medical marijuana licenses. State urged to compromise. Linda Graves, an applicant, gave updates on the issue at monthly CMMNJ meetings. Many applicants are being harmed financially by the delay. There may be additional legal challenges and appeals.

A three-judge appellate court vacated the 2018 decision to award six licenses for new medical marijuana companies and remanded it to the health department to develop a new rating system. The court did not revoke the six licenses though.

Ed Tobias, Esq. prepared a brief due March 30th—he wants more licenses. Ed also has the first license to grow hemp in NJ—he said anyone can get one for $400.

The NJ tax on medical marijuana dropped on July 1 from 6.625% to 4%. Next year at this time it will be 2% and the following year 0.

An NJ appellate court ruled in favor of reimbursement for a worker’s medical marijuana after a workplace accident. On March 10, 2020, the NJ Supreme Court affirmed the appellate decision in the Wild case and ruled employers cannot fire workers who use medical marijuana while off the job.

A Medical Cannabis Dispensary Technician training class will be held this spring at the Raritan Valley Community College in Branchburg, NJ.

NJ patients were advocating for home delivery along with home cultivation. CMMNJ encouraged supporters to send the letter from NORML to Allow Home Delivery for medical marijuana patients! The NJ MMP issued regulations on 6/25/20 to allow ATCs to begin home delivery. However, by the end of 2020, ATCs had still not implemented this service.

There was a weekly record increase of patients in the MMP during the week of 3/20/20 when over 4,000 patients joined the program. Ken said in a media interview that he thought this was likely due to an increase in community anxiety brought about by the coronavirus pandemic.

Marijuana rescheduling/descheduling and national issues

The New Jersey Superior Court Appellate Division heard oral arguments for marijuana rescheduling/descheduling in New Jersey on 11/29/16 in Trenton. Nearly a year later, in November 2017, the Appellate Court ruled that the Director of the Division of Consumer Affairs (“the Division”) in the New Jersey Attorney General’s office erred when he said he lacked the authority to reclassify/reschedule/de-schedule marijuana. The Director must reconsider his decision in the “post-CUMMA era” the court said. New Jersey must recognize marijuana's medicinal value, the court insisted. The Division recognizes that it has the authority to reevaluate how marijuana is classified under state law.

Accordingly, rescheduling/descheduling hearings were held by the New Jersey Office of the Attorney General on 4/19/18 in Newark and on 4/24/18 in Trenton. For CMMNJ testimony, click the links. We still await summaries or other results of these hearings.

Patients Out of Time has created a coalition of organizations and individuals to demand the end of federal cannabis prohibition with their Resolution to De-Schedule Cannabis. Please share.

Ken commented on a Proposed Rule by the Drug Enforcement Administration, DEA’s announcement that it will begin processing applications to cultivate marijuana for research.

On Election Day, November 3rd, 2020, the following states legalized marijuana for adults: Arizona, Montana, and South Dakota, along with New Jersey. South Dakota also legalized medical marijuana, as did Mississippi. Oregon decriminalized all drugs.  In Illinois, legal marijuana sales began 1/1/20.

On December 4, 2020, the U.S. House of Representatives passed H.R. 3884, the Marijuana Opportunity Reinvestment and Expungement Act of 2020 (MORE Act.)  This bill would decriminalize and deschedule cannabis, provide for reinvestment in persons adversely impacted by the War on Drugs, and provide for expungement of federal cannabis offenses. There are concerns about this bill.

The 2017 attack left Jawara with severe brain injuries that led to his death. Jawara was in jail because he was caught with marijuana, a sacrament in his Rastafarian Religion.

Thanksgiving Giveaway: Sativa Cross, CMMNJ, & UFCW distributed donated food, clothing and personal hygiene items to the homeless and poor of Trenton at the Trenton State House Annex on 11/26/20.

The 17th anniversary of CMMNJ’s first public event at the White Dog CafĂ© was on 3/10/20. Cheryl Miller, the multiple sclerosis patient, early NJ medicinal marijuana activist, and wife of CMMNJ co-founder Jim Miller, died on June 7, 2003.

Many thanks to the Byrne family of Ewing, NJ, who, on the untimely death of their son, Will, directed memorial contributions to CMMNJ. The Byrnes said that medical marijuana greatly improved the last year of their son’s life. Even in their grief, they reached out to help others.

CMMNJ’s 2021 Recommendations

⦁ Allow registered patients in the NJ MMP to grow a limited supply of cannabis (Home Grow Now!)

⦁ Implement a timely legalization program that brings affordable, high quality marijuana to New Jersey adults in an appropriately regulated, socially just way. See CMMNJ’s complete Adult-use Cannabis Recommendations.

⦁ CMMNJ renews its annual call for national clinical trials of marijuana.

⦁ Deschedule marijuana, both in New Jersey and nationally.

Schedule of CMMNJ 2021 meetings

Plans for 2021 are to continue with monthly Zoom meetings until further notice.

In 2020, CMMNJ held twelve free public meetings on the second Tuesday of each month from 7 - 9 PM. The meetings from January through March 2020 were held at the Lawrence Township Library in Mercer County.  (Meeting at the library does not imply the county’s endorsement of our issue.) Due to COVID-19 restrictions, the meetings from April through December were conducted via Zoom conferences.  In the past the CMMNJ Board objected to having a permanent record of meeting discussions. This was out of concerns about patient confidentiality, and patient self-incrimination when discussing use of an illegal substance. As usual, in the beginning of the Zoom meeting, participants introduced themselves and said a few words about why they were at the meeting. We advised participants that there was no way to tell if their comments were being recorded.

CMMNJ sent the agendas for these meetings via e-mail to over 1000 supporters each month and posted the agendas on Facebook, Twitter and on the CMMNJ blog.

To receive the meeting agendas, sign up!

We extend our best wishes for everyone’s safety and health during this time of pandemic, social distancing, and economic collapse.

CMMNJ Year End Report 2019

Year End Report 2019
The Coalition for Medical Marijuana New Jersey, Inc. (CMMNJ) is a non-profit, 501(c)(3) educational organization, incorporated in the State of New Jersey.  The mission of CMMNJ is to educate the public about medical marijuana.  The goal of CMMNJ is to have safe and legal access to medical marijuana for qualified New Jersey patients.

In 2019, CMMNJ held eleven free public meetings at the Lawrence Township Library in Mercer County.  (The February 2019 meeting was canceled due to snow.) At the meetings, Board members and volunteers planned upcoming events and educational programs.  CMMNJ sent the agenda and minutes of these meetings via e-mail to over 1000 supporters each month and posted the agendas on Facebook, Twitter and on the CMMNJ blog.

CMMNJ’s public meetings for 2020 will continue to be held on the second Tuesday of each month from 7 - 9 pm at the Lawrence Twp. (Mercer County) Library, 2751 Brunswick Pike
Lawrenceville, NJ, 08648.  All are welcome at these meetings and there is never a charge to attend. Meeting at the library does not imply Mercer County’s endorsement of our issue.

New Jersey Highlights of 2019:

·         Marijuana legalization for adults failed to progress through the New Jersey legislature in 2019 despite the support of the governor, the senate president and the assembly speaker, as well as a majority of voters in the state;
·         In November 2019 it was finally decided that the adult use of marijuana will be voted on as a ballot question in November 2020;
·         The Medical Marijuana Program continues to expand as Governor Murphy signed the Jake Honig law in July 2019;
·         Marijuana reform progresses nationally and regionally;
·         CMMNJ continues to await action from the NJ OAG on re/descheduling hearings conducted in the spring of 2018;
·         CMMNJ publications, activities, finances and Board report.

Marijuana legalization advanced:

In 2014, CMMNJ’s Board of Directors endorsed legalization of marijuana. The Board recognized legalization as the most efficient and effective way to get the therapeutic effects of marijuana to the vast number of patients who can benefit from this plant. Legalization of marijuana is also an important step in undoing the harms to our society that are caused by our current policy of drug prohibition.

In January 2018, Governor Phil Murphy brought a new administration to Trenton that was much friendlier to marijuana reform than the previous administration. However, the state’s adult use marijuana reform continued to be delayed throughout the year.  The primary legalization bill, S2703/A4497,  the “New Jersey Cannabis Regulatory and Expungement Aid Modernization Act” which legalizes personal use cannabis for adults passed legislative committees 11/26/18 and on 3/18/19 (see testimony to Senate Judiciary Committee & Assembly Appropriations Committee) but the hoped for floor vote did not take place on March 25. The Senate failed to get enough votes to guarantee passage. So the marijuana legalization bill was delayed. Key NJ Senators say they got more calls opposing this bill than supporting it! Supporters were encouraged to reach out to organizations and tell them to tell their members to support this bill. However, some advocates opposed the bill because it did not include home cultivation or sufficient social justice provisions. In-fighting among Democrats that had nothing to do with marijuana played a role in the failure to pass the adult use bill. Republicans in the Legislature uniformly opposed the bill.

Legalization discussions continued around NJ: Hackensack, Hoboken, Barnegat, Newark, Brick, E. Brunswick,  Rutgers U. A Monmouth University poll in February 2019 showed 62% of NJ adults favor legalization.

In September, it was hoped that the NJ marijuana legalization bill (S2703), would get a legislative floor vote in the lame duck session (early Nov. to early Jan., 2020.) CMMNJ showed support for this legislation and asked for a home cultivation bill for patients to be introduced in 2020. Advocates were encouraged to send an email to their legislators and sign the NJUMR letter!  CMMNJ produced a video in support of S2703, and sent out a Press Release, but to no avail. Two-thirds of Americans favor legalizing marijuana according to Gallup.

But the NJ legislators said they would not vote on the marijuana legalization bill, (S2703), in 2019, shortly after a State House Press Conference for the adult use bill on 11/18/19. CMMNJ supported this legislation and the efforts to force a vote continued. Now, legalization will be a ballot question in Nov. 2020. Even if the ballot question passes, the issue will return to the legislature for final bill wording and then to the Cannabis Regulatory Commission for regulations.

Gov. Murphy signed A5322 to allow hemp farming in NJ after registration with the Dept. of Agriculture.

The Drug Policy Alliance (DPA) closed their HQ in Trenton after 17 years.

New Jersey (NJ) Department of Health (DOH) Medicinal Marijuana Program (MMP):

The seventh anniversary of legal sales of marijuana in New Jersey was on 12-6-19. The ninth anniversary of New Jersey’s Compassionate Use Medical Marijuana Act becoming law was on 1-18-19.

Seven Alternative Treatment Centers (ATCs) are currently open and dispensing medical marijuana to over 60,000 qualified patients: Greenleaf Compassion Center of Montclair, Harmony Dispensary of Secaucus, Compassionate Care Foundation of Egg Harbor and Garden State Dispensary of Woodbridge and Union Township, Curaleaf of NJ in Bellmawr (Camden Co.) and Breakwater Alternative Treatment Center of Cranbury. One additional ATC opened in 2019—RISE Dispensary (GTI New Jersey), in Paterson, Passaic County, NJ. The new ATC is scheduling appointments to dispense medicinal marijuana to patients and/or their caregivers, and accepting walk-ins. A patient can change their ATC whenever they wish but can only be registered with one ATC at a time.

NJ DOH OK’d 6 applications for ATCs on 12/17/18 in Atlantic City, Elizabeth, Ewing, Paterson, Phillipsburg & Vineland. Applicants must comply with background checks and state and local regulations. Only RISE in Paterson has opened so far. The DOH selected 6 applicants:

  • NETA NJ, LLC – Phillipsburg
  • GTI New Jersey, LLC – Paterson
  • Verano NJ LLC – Elizabeth (Dispensary), Rahway (Cultivation Site)
  • Justice Grown – Ewing
  • MPX New Jersey – Atlantic City (Dispensary), Galloway (Cultivation)
  • Columbia Care New Jersey – Vineland
NJ DOH published MMP Biennial Report 4/1/19. Recommendations therein were to: Raise the 2 ounce per month limit; Lower prices by expanding supply, access and competition; Increase cultivation sites to 24, & add 50 dispensary sites. CMMNJ Board members interviewed. MMP has over 40,000 patients. Opioid Use Disorder was approved for marijuana therapy in conjunction with Medication Assisted Treatment.

NJ DOH MMP proposed regulations from the Division of Medicinal Marijuana were filed on May 24, 2018. CMMNJ submitted written comments on 8/17/18. The DOH adopted new rules effective 5/20/19, making it easier to add qualifying conditions.

By June 2019, the MMP expanded to 47,500 patients, 950 doctors.

The medical marijuana expansion act, S10/2426, was stalled, after sailing through three legislative committees on November 26, 2018. This bill was tied to the legalization bill, though there was really no reason that it could not advance on its own. Governor Murphy signed the medical marijuana expansion act, S20/A20 into law on 7/2/19, effective immediately. It included:
  • Patients may visit doctors only once a year;
  • there is an increase in allowable limits to 3 ounces/month for all, and unlimited amounts for hospice patients;
  • Advanced Practice Nurses (APNs) and Physicians’ Assistants (PA’s) will be permitted to recommend marijuana;
  • edibles, tinctures, and sublinguals are now permitted for adults as well as minors;
  • various patient protections were included for workplace, housing, child care, etc.;
  • the state sales tax will be eliminated in 2022;
  • institutional caregivers will be able to procure medical marijuana for patients in health care facilities;
  • educational programs will be developed;
  • research will be conducted;
  • out-of-state ID cards will be honored, etc.
Home cultivation is still not considered for NJ patients, however. CMMNJ wants 30-second video testimony on why patient/caregiver home cultivation and co-ops are necessary and what being legal means to you. Send to #CMMNJ: https://www.facebook.com/CoalitionforMedicalMJNJ/ Ken was interviewed on 101.5 FM about ATC prices and advocated for home cultivation for patients.  CMMNJ participated in a rally in Trenton for home cultivation on 11/25/19.

A number of patients complain physicians refuse to discuss cannabis with their patients. CMMNJ requested documentation of these refusals—who, what, when, where, and why.

Jim Miller started a campaign including a petition to end the sales tax on medical marijuana immediately.

DOH issued an RFA for 108 new ATCs in NJ, including 24 for cultivation, 30 for manufacturing & 54 for dispensaries. Applications were due August 15, 2019. DOH changed and reissued the RFA for 24 new ATCs in NJ on 7/1/19, including up to 8 in the north, 8 in central NJ, 7 in the south, and 1 “at-large”; these include 5 for cultivation, 15 dispensaries, and 4 vertically integrated permits. Application forms were posted July 15; due on 8/21 (Dispensary) and 8/22 (Cultivation & Vertically Integrated). Pre-Application Webinar was held on 8/2/19. Applicants sought community support for proposed ATC sites in Trenton, Brick, Vineland, Clayton, etc.

NJ’s first death associated with vaping was noted. The NJ DOH MMP said there were no reports of serious lung illness associated with products sold in NJ ATCs.  The problem should spur legislators to make vaping safer through regulations, not bans, just as we made cars safer in response to traffic deaths.

The Superior Court Appellate Division ruled that Medical Marijuana users may not be Discriminated Against In New Jersey

N.J. Supreme Court took the case of a funeral director fired for using medical marijuana.

With CMMNJ’s encouragement, advocates attended and spoke up at local council meetings and other civic meetings throughout the state in support of marijuana reform. Jim Miller went to the Toms River council and Lefty Grimes and the Ignorance is No Excuse tour went to many communities.

Marijuana rescheduling in New Jersey:

The AG’s office announced that it will not further pursue its appeal.

CMMNJ called the NJ OAG re: results of marijuana rescheduling hearings 4/19/18, Newark & 4/24/18 Trenton, but there was no reply from the OAG. The OAG is reportedly still working on it.

Marijuana reform progresses nationally, regionally and internationally:
The “Compassionate Access, Research Expansion and Respect States” (CARERS) Act & the “Marijuana Justice Act” were re-introduced in the 116th Congress. New Congressional Dems plan to hold House hearings.
Illinois was the 11th state to legalize marijuana for adults. The legislature sent the bill to governor.

Drug Enforcement Administration’s announcement: it will begin processing applications to cultivate marijuana for research. Reg proposal first. Hemp is no longer a controlled substance.

Change.org petition for Nobel Prize for Raphael Mechoulam supported.
House passes historic SAFE Act that would allow cannabis businesses to open bank accounts

Feds continue to prohibit the Department of Justice from using its resources to prosecute individuals acting in compliance with state medical marijuana laws. However, President Trump said, in a signing statement, that he still could enforce federal laws.

House passed the MORE Act out of committee! Federal marijuana reform progress.

Jahan Marcu’s “Journal of Endocannabinoid Medicine” launch 11/15/19, & ABC7 report.

June 7th was the anniversary of Cheryl Miller’s death in 2003.

Statehouse Podcasts:

CMMNJ participated in a series of Statehouse Podcasts going back to 2014.  The final 2019 Statehouse Podcast concluded with Thanksgiving Day lunch/clothing giveaway outside the Annex. Permits were obtained from the State Police each week for the demonstrations.  The podcasts and demonstrations called attention to the deficiencies of the MMP and the need for legalization of marijuana and home cultivation.

CMMNJ is grateful for the generous financial support of all who contributed to our mission to educate the public about the benefits of medical marijuana. CMMNJ is especially grateful to those who contributed anonymously through Network for Good, whose donations totaled $373 in 2019. CMMNJ is unable to individually thank those who donated through Network for Good since the donations are listed as anonymous.

CMMNJ Board members will be encouraged to increase fundraising efforts in 2020 in order to be in a better position to meet our objectives and goals.

CMMNJ’s 2020 Recommendations:
