Senate testimony opposing Recriminalization of Cannabis Possession

RE: Opposition to S4154 – Recriminalization of Cannabis Possession

Dear Chair and Members of the Judiciary Committee,

I submit this statement in strong opposition to Senate Bill 4154. As a cancer patient living with chronic pain from spinal trauma, and a board member of CMMNJ, I have seen the consequences of cannabis prohibition up close. This bill would represent a devastating step backward.

1. This Bill Punishes the Poor and the Sick

Legal cannabis remains inaccessible for many in New Jersey. Prices are exorbitant, often over $400 per ounce. Dispensary products are inconsistently labeled, and too often, patients report contamination and poor quality. And yet, patients are still not allowed to grow their own medicine. For those of us relying on cannabis to manage serious health conditions, this bill sends a clear message:

If you can’t afford it—you can go to jail.

2. This Is a Protectionist Bill for Industry, Not Public Safety

S4154 will not make New Jersey safer. It will simply expand criminal penalties for those shut out of the legal market. In doing so, it shields licensed operators from competition while offering no solutions to the real issues: affordability, access, and product safety.

3. This Is a Racial and Economic Justice Issue

Cannabis arrests in New Jersey have historically targeted Black and Brown communities. S4154 revives the exact playbook that devastated those communities for decades. It is an unacceptable regression.

What We Need Instead

  • Legal home cultivation for patients

  • Regulation that enforces product safety and transparency

  • Policies that ensure accessibility and affordability, not criminalization


As someone who lives with disability and chronic illness, and who relies on cannabis as part of a lifesaving regimen, I am appalled that this Legislature would consider putting arrest and prosecution back on the table for people like me.

I urge you in the strongest possible terms: Reject S4154.

Let’s move forward, not backward.

Let’s protect people, not profits.

WHAT:   Renewed endorsement of medicinal cannabis insurance bills

WHERE: In the New Jersey State Legislature     

WHEN:   During Nurses Week/Nurses Month, May 2025

WHY:    To improve healthcare in New Jersey


Judith Schmidt, RN, the Chief Executive Officer of the New Jersey State Nurses Association/Institute for Nursing (NJSNA/IFN) and Margaret Daingerfield, NJSNA President, confirmed the continuing support of the NJSNA for the following bills to provide insurance coverage for medicinal cannabis:

  • S1944: Allows costs of medical cannabis to be reimbursed by Catastrophic Illness in Children Relief Fund, PAAD, Senior Gold and VCCO.
  • S1943/A4371: Requires workers' compensation, PIP, and health insurance coverage for the medical use of cannabis under certain circumstances.
  • A898/S2828: Establishes program to subsidize purchase price of medical cannabis for registered qualifying patients enrolled in Medicaid or NJ FamilyCare programs. 

Ken Wolski, RN, MPA, Executive Director of the Coalition for Medical Marijuana--New Jersey, Inc. said, “When passed into law, these bills will make the medical benefits of cannabis available to many residents who have been impoverished by their illnesses or injuries. These bills will also reduce healthcare costs in the state. Cannabis stabilizes multiple conditions. Greater access to cannabis therapy will allow patients to require:

  • fewer pharmaceuticals;
  • fewer surgical procedures; and,
  • fewer emergency room visits and hospitalizations.”

Previous versions of S1944 passed out of the Senate Health Committee on 3/10/22 and the Assembly Health Committee on 5/24/22. Previous versions of S1943 passed out of the Assembly Financial Institutions and Insurance Committee on 2/13/20 and the Assembly Appropriations Committee on 10/26/20.

Bill A913 to allow NJ patients to use medicinal cannabis for sickle cell anemia passed two Assembly committees. “Praise God,” said cannabis activist Leo Bridgewater. But the companion bill, S2392, has yet to have a committee hearing.

NJ’s medical cannabis home cultivation bill S1393 has bipartisan co-sponsors, but no committee hearing scheduled yet. The identical Assembly bill is A846.

NJ-CRC celebrate 4 years of building NJ's cannabis industry; as of January 2025, average cost of flower at licensed dispensaries is down to $9.92 per gram for recreational consumers and $9.29 per gram for patients.

My oral comments to the NJ CRC at the March 25, 2025 Medicinal Cannabis Program Town Hall start at 1:01:17 and end at 1:04:06, less than three minutes. I hope they address my concerns, though they haven’t for about seven years now.

The CRC began accepting applications for Cannabis Consumption Areas on January 2nd from Social Equity and Economically Disadvantaged Area businesses only. On April 2nd, micro and diversely owned, and on July 2nd, from everyone else.

Hospital and Institutional Access:

NJ patients in hospitals, nursing homes, state institutions, group homes and hospice need access to medical cannabis. Patient outcomes would improve, and health care costs would be reduced with access to medical cannabis. Newark's University Hospital, the state's only public hospital, should implement Institutional Caregivers so that patients may continue their physician-recommended cannabis treatment while hospitalized.

 

In 2023 CMMNJ endorsed psychedelic research and the safe use of psychedelics.  A3852/S2283 "Psilocybin Behavioral Health Access and Services Act"
