NJ Medical Marijuana Patients To Governor-elect Murphy: We Need Home Cultivation

New Jersey Medical Marijuana Patients To Governor-elect Murphy: We Need Home Cultivation 

Trenton: Registered medical marijuana patients in New Jersey will gather at the State Capitol Building Annex, Room 9 on December 7th at 10:00 a.m. for a press conference calling on legislators and Governor-elect Phil Murphy to allow home cultivation of cannabis. 

Advocates will highlight the stories of patients serving prison time for a handful of plants and will have a model of a small home medical marijuana grow on display. 

Peter Rosenfeld, a board member of the Coalition of Medical Marijuana New Jersey (CMMNJ), pointed out that caregivers and patients were expecting home gardens until the provision was removed in 2009 from the Compassionate Use of Medical Marijuana Act. Almost a decade later and the promises of a robust medical marijuana program have been broken.

“Patients are still being arrested or moving away due to the problems in the state's program,” says Rosenfeld, “The price is unaffordable to many, and the dispensaries have difficulty in staying stocked with the strains that patients need.”

The demonstration of a typical home cultivation setup will include 2-3 flowering plants, LED lights and 2-3 immature plants. This style of indoor garden will cost much less than what a patient currently spends on an ounce of dried flower from the state dispensaries. 

Ken Wolski RN, Executive Director of CMMNJ, who will be speaking at the press briefing said, “Home cultivation empowers patients to take charge of their own healthcare, to grow their own medicine for pennies and to choose the specific strains that best helps their medical conditions.”

Rosenfeld added, “As New Jersey moves on to full legalization of marijuana we want legislators and Governor-elect Murphy to consider the needs of our state's medical marijuana patients.” 

CMMNJ will have copies of model legislation that contains detailed improvements. CMMNJ also extends an open invitation to Governor-elect Murphy to attend our next meeting in Lawrenceville.

Election- Despite new Gov’s intent to sign a legalization Bill quickly, it is doubtful that legal MJ will be available for a year because of details to be worked out in Regs.  However, activists can push for tangential issues that can be immediately implemented such as prohibiting any arrests for use, expunging all use arrests and those for supplying friends (i.e., all those not major dealers).

Also, provision must be made to support minority representation in gaining licenses to sell with reduced license fees in minority communities and eliminating any bar due to MJ arrest or those charges related thereto (resisting arrest, etc).

 As part of legalization we can advocate for patient growing for own use and other useful expansions of the CUMMA (my note and eliminating many of the unjust burdens like requiring Dr. registrations-esp with Trump admin.)  On growing we should emphasize it was in the original Bill and unjustly eliminated in secret.

Review Panel Approvals- Main point is that we know Gov. Christie is running out the clock so we need to quickly contact new Health Commissioner to immediately sign approval-we have contacts (e.g. Bill Caruso) to get us an inside track. I recommended contacting the DOH transition team. There is no need to delay for the full 180 days. This can be done the first day the new Commissioner takes over if we do advance planning.

Appellate Court action – despite the euphoria I pointed out that the court did not mandate a change only instructed the Director that he had the ability and he should review his position. This is wasted on a Christie appointee.  Again-we need to have the new Admin take Immediate action on this as a priority -even if just to help patients with issues such as use on school grounds.

Podcast last one for this year (and the 100th) is on Thanksgiving and it will provide food. Hoping for media coverage and food donations.
Brunch on Nov 18th at Studio B in Trenton (formerly Prayer Brunch-and no Al Sharpton) Cost is $25. There are speakers.

NJ panel OKs marijuana for more conditions


The Medicinal Marijuana Program Review Panel--five physicians, two pharmacists and one RN, who were appointed by the New Jersey Department of Health—gave their final approval on October 25th for the use of marijuana for a number of additional medical conditions.

Dr. Alex Bekker, MD, PhD, a professor and department chairman at Rutgers New Jersey Medical School, led the panel of medical experts that approved marijuana therapy for chronic pain, anxiety, migraines, and Tourette's syndrome.

About one third of all Americans suffer from chronic pain at sometime in their lives. Indeed, 32 of the 45 petitions that the panel reviewed were related to chronic pain. In approving marijuana therapy for pain, the panel relied on over 400 peer-reviewed journal articles to make their evidence-based decision. The National Academy of Sciences also endorsed medical marijuana for chronic pain when “conventional therapies fail.” The panel noted the many side effects, and possible severe adverse effects, of both prescription opiates and over-the-counter pain relievers. The panel acknowledged that there were significantly fewer opiate overdose deaths in states with robust medical marijuana programs.
 
The panel said that opiate addiction is a “public health emergency” in America, the day before President Trump formally declared this emergency. Marijuana has been shown to be an effective substitute for pharmaceutical pain relievers and can also help ease the withdrawal from opiate addiction.

One of the chronic pain petitions that the panel approved was MMP-063, “Opioid Use Disorder.” This petition was submitted by Vanessa Waltz, a Board Member of the Coalition for Medical Marijuana--New Jersey. In approving this condition to qualify for marijuana therapy in the state's program, the panel recognized that marijuana, far from being a “gateway” to harder drug use, is actually an “exit drug.” In 1999, the Institute of Medicine thoroughly repudiated the Gateway Theory saying, “There is no conclusive evidence that the drug effects of marijuana are causally linked to the subsequent abuse of other illicit drugs.” Even the Drug Enforcement Administration (DEA) acknowledged in the July 8, 2011 Federal Register that there was no “direct causal relationship between regular marijuana and other illicit drug use.” The reality is that marijuana can be an exit drug from addicting and dangerous prescription drugs, from street drugs like heroin, and even from alcohol addiction and overuse.

The panel also approved anxiety, both primary and secondary anxiety (related to Autism and Alzheimer’s disease). The panel noted that anxiety can be debilitating. When anxiety does require pharmaceutical intervention, most conventional treatment is unacceptable. The benzodiazepams, or minor tranquilizers, for example, are widely abused and withdrawal from them can be life-threatening. Anti-depressants are often prescribed for anxiety, but they are not effective for two to six weeks, and anxiety is not a depressive illness. The panel felt that there was a significant place for marijuana in fighting anxiety.

Also given final approval by the panel were migraine headaches and Tourette’s syndrome. The panel cited articles and research by Dr. Ethan Russo in support of marijuana for migraines. Dr. Russo is one of the leading authorities in medical marijuana in the United States. In approving marijuana for Tourette’s, the panel noted that there currently is no accepted nor effective pharmacologic treatment for the syndrome. Only major tranquilizers (anti-psychotic or neuroleptics drugs) are prescribed, but Tourette’s is not a psychotic disorder.

The panel only rejected two petitions, MMP-020 Asthma, and MMP-055 Chronic fatigue syndrome. The panel was not convinced that there was sufficient evidence presented in the petitions to support including these two conditions in New Jersey’s Medicinal Marijuana Program.

The panel should be congratulated for its research, its thoroughness and its courageous adherence to evidence-based criteria in its decision making. When the science is objectively pursued, the therapeutic potential of medical marijuana is found to be enormous.

Now the commissioner of the Department of Health has 180 days to decide what, if any, of the panel’s final recommendations to accept. In recognition of the now formally declared public health emergency that is the opiate epidemic in America, the commissioner must act speedily in adopting the final recommendations of the panel. Lives are at stake.

Indeed, the entire country should follow the final recommendations of the experts in New Jersey’s Medicinal Marijuana Program Review Panel.

Informational hearing on NJ State Sen. Scutari’s legalization bill (S3195) held at Senate Judiciary Committee on 6/19/17. CMMNJ testified in support of the bill and called for public use of marijuana. CMMNJ also called for CUMMA amendments—repeal 7% medical tax; add home cultivation; & reschedule marijuana. Leo spoke with Scott Rudder today; NJ CannaBusiness (NJCBA) does not support home cultivation for S3195, but does for CUMMA. Jim Miller will do a letter template for home cultivation, addressing concerns. Election is coming up; keep those cards and letters coming. NJCBA networking event 9/27, 3-8 pm. NJCIA event is on 9/14/17, 8:30 am to noon. NJ launched a chapter of Women Grow. Leo involved with Minorities for Medical Marijuana. Christie is out of office on 1/16/18.

Thank you for contacting me to express your support regarding S. 1689, the Marijuana Justice Act.  Your opinion is very important to me, and I appreciate the opportunity to respond to you on this critical issue.

The Marijuana Justice Act would remove marijuana from the Controlled Substances Act, making it legal at the federal level.  The bill would incentivize states through federal funding to change their marijuana laws if it is illegal in the state and the state disproportionately arrests or incarcerates minorities or low-income individuals for offenses related to marijuana.  Additionally, the bill would automatically expunge federal marijuana use and possession crimes, and it would allow an individual currently serving a sentence in federal prison for a marijuana offense to petition a court for resentencing. 

I have long supported legislation that would have prohibited the use of federal funds to prosecute individuals who use medicinal marijuana in states that legally permit it.  At the same time, I vigorously support efforts to keep marijuana out of the hands of our youth given the dangers of substance abuse.  Please know that I will keep your views in mind as I continue to review this legislation.

To whom it may concern:

I want to thank the Medicinal Marijuana Review Panel (MMRP) for giving initial approval to 43 of the 45 petitions to add qualifying conditions to New Jersey’s Medicinal Marijuana Program (MMP).

Members of the Coalition for Medical Marijuana—New Jersey (CMMNJ) submitted or contributed to eight of these petitions, seven of which were approved by the panel, so it was gratifying to see this affirmation of our efforts. The panel recognizes, as CMMNJ does, that there are a great many New Jersey residents who are currently suffering with conditions that could be helped by medical marijuana.

Our main concern is the agonizingly slow pace of the process to expand patient access to the MMP. It has been over one year since the Department of Health (DOH) accepted the petitions that it is now considering.  The MMRP made its initial recommendations to expand the program on 5/11/17, but it took two and a half months, until 7/25/17, for the DOH to post these recommendations on its web site and start the 60-day public comment period. These delays cause needless suffering.

CMMNJ urges the Commissioner of the DOH to end these delays and to adopt the final recommendations of the panel immediately, and not wait 180 days to do so. Thank you.

Here's what the legal pot bill would do
Scutari's bill, (S3195) based on visits to Colorado's thriving recreational program would:
Decriminalize marijuana possession of up to 50 grams "immediately" and allow people who have been arrested for pot possession to expunge their records.
Establish a Division of Marijuana Enforcement in the state Attorney General's Office which would create the rules used to govern the legal market of growers and sellers.
Allow people to possess up to one ounce of dried marijuana, 16 ounces of edible products infused with cannabis, 72 ounces in liquid form and seven grams of marijuana "concentrate."
Impose a sales tax on recreational sales beginning at 7 percent in the first year, climbing to 10 percent in the second year and jumping five percent more each year until it reaches 25 percent. Taxes on medical marijuana would be abolished.
Give the five existing medical marijuana dispensary nonprofit groups first crack at selling recreational pot.

May 2017 Minutes approved.

Sen. Scutari introduced legalization bill (S3195) on 5/15/17 at State House press conference. CMMNJ issued a press release: Legalization is the best way to get the right medicine to the most people. CMMNJ to call for CUMMA amendments—repeal 7% medical tax; add home cultivation; & reschedule marijuana. Informational hearing at Senate Judiciary Committee scheduled for 6/19/17. Trump effect??

NJ DOH Medicinal Marijuana Program Review Panel gave initial approval to 43 of 45 petitions to add conditions to the MMP (only Asthma and Chronic Fatigue denied). A 60 day public comment period to start soon(?), followed by final rec’s.

Leo Bridgewater is president of NJ Chapter of “Minorities for Medical Marijuana” a national org., and he is also affiliated with NJ CannaBusiness Assn. Mercer County Community College wants to have a place for medical marijuana patients to smoke on campus.

Here's what the legal pot bill would do
Scutari's bill, (S3195) based on visits to Colorado's thriving recreational program would:
Decriminalize marijuana possession of up to 50 grams "immediately" and allow people who have been arrested for pot possession to expunge their records;
Establish a Division of Marijuana Enforcement in the state Attorney General's Office which would create the rules used to govern the legal market of growers and sellers;
Allow people to possess up to one ounce of dried marijuana, 16 ounces of edible products infused with cannabis, 72 ounces in liquid form and seven grams of marijuana "concentrate;
Impose a sales tax on recreational sales beginning at 7 percent in the first year, climbing to 10 percent in the second year and jumping five percent more each year until it reaches 25 percent. Taxes on medical marijuana would be abolished.
Give the five existing medical marijuana dispensary nonprofit groups first crack at selling recreational pot.
