House votes to end war on medical marijuana

WHY:      To respect the traditional right of states to determine the practice of medicine 

In the U.S. Congress last week the House of Representatives voted to stop funding the federal war on medical marijuana programs.  Jay Lassiter, a participant in New Jersey’s Medicinal Marijuana Program said, “I’m happy to see this vote play out in Congress. It's a long-overdue discussion.”

Since 1996, twenty one states and the District of Columbia have passed medical marijuana laws.  The federal government, however, considers marijuana a Schedule I substance with no accepted medical uses.  The Supreme Court (SCOTUS) has ruled that the federal government is within its powers to enforce its laws against marijuana even in states that have medical marijuana programs.  At the same time, the SCOTUS has not invalidated any of the medical marijuana laws, and has said that physicians cannot be penalized for recommending marijuana for their patients.

On Friday, May 30 the House voted 219-189 in favor of the Rorhabacher-Farr Amendment to the government’s appropriations bill.  This amendment prohibits the use of funds to the Justice Department, including the Drug Enforcement Administration (DEA), if those funds “prevent certain States from implementing their own State laws that authorize the use, distribution, possession, or cultivation of medical marijuana.”  The vote saw more support from Democrats than from Republicans as 170 Democrats and 49 Republicans voted yes, while 17 Democrats and 172 Republicans voted no on the amendment.  New Jersey’s representatives voted as follows:
Democrats – Holt, Y; Pallone, Y; Pascrell, Y; Payne, Y; Sires, Y.
Republicans – Frelinghuysen, N; Garrett, Y; Lance, N; LoBiondo, Y; Runyan, Y; Smith, N.

Now the measure must go to the U.S. Senate.  While the Senate is controlled by Democrats, no measure to protect medical marijuana patients or programs has yet been introduced in the Senate.  If and when the measure passes in the Senate, it will have to be signed into law by President Obama.

CMMNJ to protest DEA’s ruling that marijuana is not medicine

The Coalition for Medical Marijuana--New Jersey (CMMNJ) will publicly destroy a copy of the Federal Register that contains a ruling by the Drug Enforcement Administration (DEA) that marijuana is not medicine. The demonstration is planned for Thursday, February 16, 2012 at 12 noon in front of the Trenton Federal Building at 402 E. State St., Trenton, NJ. The demonstration will coincide with similar demonstrations across the country in honor of national Medical Marijuana Week (Feb. 13-17).

The Federal Register Vol. 76 No.131 dated July 8, 2011 contains the DEA’s most recent denial of a petition to reschedule marijuana. The DEA continues to insist that marijuana is appropriate as a Schedule I drug. Schedule I drugs have “no currently accepted medical use in treatment in the United States;” lack “accepted safety for use under medical supervision;” and, have “a high potential for abuse.”

Ken Wolski, RN, executive director of the Coalition for Medical Marijuana--New Jersey (CMMNJ) said, “It is an outrage that the federal government continues to deny the benefits, and exaggerate the dangers of marijuana. This is an affront to the laws of 16 states, an affront to scores of healthcare organizations, an affront to the emerging science of medical marijuana, and an affront to countless patients nationwide who use marijuana with their doctor’s recommendation.”

Americans for Safe Access, a national medical marijuana organization, suggests specific actions during Medical Marijuana Week:

1. Monday, February 13: Call the White House at 202-456-1111 and tell President Obama to keep his promise not to use Justice Department resources to undermine state laws.
2. Tuesday, February 14: Contact Congress, 202-224-3121, and urge your representative to sponsor legislation to reclassify cannabis and end federal interference in state programs.

Stop DEA Raids in Medical Marijuana States

Dear Senator Lautenberg:

As you are aware, in January 2010 New Jersey enacted Legislation authorizing qualified patients upon their doctor’s advice to use marijuana medicinally. The law requires patients to register and comply with a program administered by the State. In support of such programs, last year United States Attorney General Eric Holder issued a guidance memorandum* to US Attorneys in states that authorized medical marijuana.

This Memorandum instructed them to essentially focus resources on areas other than medical marijuana programs. Considering the tremendous threats to public safety and the country’s welfare posed by terrorism, murder, kidnapping, bank robbery, fraud, drug cartels, public corruption, money laundering, counterfeiting, etc., AG Holder essentially challenged federal prosecutors to focus on concerns other than patients using medical marijuana in accordance with state law. At the time he issued this Memorandum he was doubtlessly aware of the holding in City of Garden Grove v. Superior Court. In this case, California's Fourth District Court of Appeal held that the medical use of marijuana by patients pursuant to State law was legal use, not pre-empted by federal concerns. The court also noted the right of the state to determine medical standards. In response to a petition of certification by the prosecution, the US Supreme Court declined to review that decision.

In light of the above, we were outraged to learn that on February 12, 2010 in Colorado, another medical marijuana state, the Drug Enforcement Administration raided the home of medical marijuana caregiver Chris Bartkowicz, confiscated his property and arrested him.** Compounding this inordinate waste of public resources is the fact that Jeffrey Sweetin, the DEA special agent in charge of the Denver office, and the lead agent in the raid, was quoted in the Denver Post as saying that marijuana “is not medicine.” In addition to being patently incompetent to make such a statement, he is completely wrong, as hundreds of studies and the attestations of tens of thousands of patients has proven. As noted above, even the US Supreme Court recognizes that if a state says that marijuana is medicine, then marijuana is medicine in that state. One would expect that the DEA agent responsible would, as a minimum, be disciplined for this wretchedly irresponsible conduct.

My purpose in writing to you is to request that your office contact Attorney General Holder and request assurance that the federal government will not waste federal resources harassing New Jersey patients participating in this State’s medical marijuana program. Please remind him that patients are not criminals. If the US Attorney has sufficient resources to not only adequately combat all the actual crimes noted above but also to persecute patients, it is evident that the US Attorney’s budget is overly generous and should be reduced.
