Agenda: 

January 11th 2022 marked the start of the 2022-2023 New Jersey Legislative Session. The following lawmakers will deal with newly introduced and reintroduced cannabis bills: Senate Chamber Seating and Assembly Chamber Seating.

Insurance bills: 

S313: Allows costs of medical cannabis to be reimbursed by Catastrophic Illness in Children Relief Fund, PAAD, Senior Gold and VCCO. 

S309: Requires workers' compensation, PIP, and health insurance coverage for the medical use of cannabis under certain circumstances.

S782: Establishes program to subsidize purchase price of medical cannabis for registered qualifying patients enrolled in Medicaid or NJ FamilyCare programs.

A389: Creates certain protections for insurers and insurance producers engaging in business of insurance in connection with cannabis-related businesses.

Home cultivation bills:

S342/A997: Authorizes home cultivation of medical cannabis.

A1422: Legalizes possession of six or fewer marijuana plants, subject to enactment of legislation legalizing marijuana or cannabis for personal use.

S353: Legalizes growing or possessing up to six marijuana plants for personal recreational use, and up to 10 plants for personal medical use, by persons 21 or older.

Tax Issues:

ACR51: Proposes constitutional amendment to dedicate tax revenue from sale of recreational marijuana for property tax relief.

ACR52: Proposes constitutional amendment to dedicate tax revenue from legal sale of recreational marijuana for mental health, addiction recovery and drug rehabilitation.

A969/S253: Exempts from sales and use tax sales of medical marijuana.

S876: Provides medical cannabis is not subject to State sales tax.

S340/A1676: Decouples State tax provisions from federal prohibition on cannabis business deductions, but only for businesses with less than $15 million of gross receipts.

A533: Allows certain microbusiness cannabis licensees to accelerate depreciation of property under corporation business and gross income taxes.

Employment issues:

A1830: Establishes protection from adverse employment action for authorized medical cannabis patients.

A890: Provides employer and employee protections pursuant to the use of legalized cannabis items.

Miscellaneous:

A197: Authorizes medical marijuana for treatment of substance use disorder; authorizes all patients to be dispensed medical marijuana in edible form.

A915: Applies ethics and conflicts-of-interest standards for casino industry regulators and participants to regulators of and participants in legalized marijuana marketplace.

S521: Expressly authorizes medical cannabis patients under 18 years of age to have up to four designated caregivers.

S642: Removes criminal liability for law enforcement officers who have encounters with underage persons for possession of alcohol or cannabis unless civil rights are violated.

AJR16: Establishes task force on cannabis related traffic fatalities.

A785: Requires New Jersey Student Learning Standards in Comprehensive Health and Physical Education include content on risks of cannabis.

A1354: Clarifies prohibition on smoking of cannabis in public places.

A1978: Provides that defendant who participated in diversion program for certain marijuana offenses on prior occasion may again participate under certain circumstances.

A1684: Directs CRC to adopt regulations concerning labeling, marketing, and sale of cannabidiol and products containing cannabidiol; prohibits sale of cannabidiol to minors.

Agenda: Randolph, NJ's CANNABIS LEGALIZATION FACT SHEET

• Adults (ages 21 and up) may legally purchase and possess up to six ounces of marijuana without facing any criminal or civil penalties. 

• It is not a crime to be under the influence of marijuana or hashish, or to possess marijuana paraphernalia or to be in possession of it while operating a car. The state still has laws against driving under the influence of drugs. 

• Criminal penalties will be reduced for those found with larger quantities (distribution of more than one ounce, but less than five pounds). 

• Those under 21 found with weed will be given a series of written warnings, rather than criminal penalties or fines. 

Cannabis Regulatory Commission (CRC)

The CRC will be developing the regulations for the new laws within 180 days (August 22, 2021) of the law’s signing. The CRC will license, and oversee the licenses for, six different sectors of the weed economy: cultivator, manufacturer, wholesaler, distributor, retailer, and deliverer. There will also be licenses set aside for “microbusinesses” with 10 or fewer employees, and for minority, women, and disabled-veteran owned businesses. 

The CRC invited CMMNJ to address its June 1, 2021, meeting on the following topics: Concentrates and edible cannabis products; Protecting patient access during recreational market availability:

What non-oil-based concentrates and edible products would make medical cannabis easier to take, more effective, and more accessible?  Should similar products be available to recreational users?

How would new product types--particularly those with high potency--impact public health and safety?

CMMNJ’s written testimony is on the CMMNJ blog. Patients should have access to “anything” they need. High-potency items should have warnings and dosage recommendations.

CRC meetings were held on 4/12, 4/22, 5/4, and 6/1 and can be viewed here. The next meeting is scheduled for July 13. Submit comments in writing to the Commission here or by emailing MMPquestions@doh.nj.gov 

EAZE wants to distribute free cannabis in NJ as part of their Compassionate Care program, but the issue is a “gray area.” How can we get the CRC to OK this?

NJ MMP: ASCEND Grand Opening, Rochelle Park, NJ, 5/19/21.
Zen Leaf Lawrence Twp., NJ, opened recently, the 18th dispensary in NJ.
Ascend Wellness in Fort Lee and Curaleaf dispensaries in Edgewater Park and Bordentown were approved by the CRC to open.
The CRC is working “as quickly as it can” to award 24 new medical marijuana licenses from the lawsuit-delayed 2019 RFA.

NY Times: “You can’t always find the strain that…works best for your condition,” said Ken Wolski, a retired nurse who now leads the CMMNJ, a nonprofit advocacy group. “And that’s a very frustrating thing for patients.”
  • A5363/S3420 legalizes cultivation of eight medical cannabis plants.
  • S3407/A5435 legalizes cultivation of six plants for any NJ adult.

Research Study: Rutgers U. will study the characteristics and cannabis-related attitudes and behaviors of medical and recreational cannabis users. The study will involve a 30-minute web-based survey of 1,200 adult (18+) marijuana users in NJ (600 medical users and 600 recreational users) beginning July 2021. Dr. Anna Kline is PI on the project. Participants are eligible for a $25 gift card. 

National: The Marijuana Opportunity Reinvestment and Expungement (MORE) Act, to remove cannabis as a federal Schedule I drug, was reintroduced into the U.S. House on 5/28/21. It passed there in Dec. 2020.
The Mississippi Supreme Court overturned the medical cannabis law voters OK’d 11/2020. 
Alabama became the 36th state to legalize medical cannabis on 5/17/21.

NJ marijuana reform delayed. S2703/A4497: The “New Jersey Cannabis Regulatory and Expungement Aid Modernization Act” which legalizes personal use cannabis for adults passed legislative committees on 11/26/18 and on 3/18/19 (see testimony to Senate Judiciary Committee & Assembly Appropriations Committee) but the hoped for floor vote did not take place on March 25, as the Senate failed to get enough votes to guarantee passage. Expungement expanded to included possession of up to 5 pounds. $42/oz tax agreement stands with local tax added. Ballot question coming if no law passed by September? 62% of NJ adults favor legalization in Feb. 2019 Monmouth U. poll. Write LTEs and Op Eds. Demonstrate support. NJUMR supports S2703. The medical marijuana expansion act, S10/2426, is also stalled, after sailing through three NJ legislative committees, also on 11/26/18 and 3/18/19.

NJ DOH published MMP Biennial Report 4/1/19. Recommendations: Raise the 2 ounce per month limit; Lower prices by expanding supply, access and competition; Increase cultivation sites to 24, & add 50 dispensary sites. CMMNJ Board members interviewed. MMP has over 40 K patients. OUD OK’d for marijuana therapy in conjunction with MAT.

March 12, 2019

January 2019 minutes approved.

NJ marijuana reform delayed. S2703/A4497: The “New Jersey Cannabis Regulatory and Expungement Aid Modernization Act” which legalizes personal use cannabis for adults passed legislative committees 11/26/18 but there has been no floor vote. $42/oz tax agreement, along with 3% excise tax and 2% local tax. Expungement appears to be only for possession of one ounce or less. The votes appear to be short: 5 in the Senate and 3 in the Assembly. S. Jersey effort needed.  Ballot question may be coming, and CMMNJ would support this if there is no resolution by June or September. Meanwhile, illegal, unregulated market thrives. Legalization discussions around NJ: Hackensack, Hoboken, Barnegat, Newark, Brick, E. Brunswick,  Rutgers U. 62% of NJ adults favor legalization in Feb. 2019 Monmouth U. poll.

Ask your elected official to support legalization.

Progress in PA & NY to legalize marijuana in 2019.

Compassionate Access, Research Expansion and Respect States (CARERS) Act & The Marijuana Justice Act were re-introduced in the 116th Congress. New Congressional Dems plan to hold House hearings.

Legalization sets the table for overcoming stigma and further reforms. DPA supports home cultivation but do not appear enthused about it.

The medical marijuana expansion act, S10/2426, is also stalled, after sailing through three NJ legislative committees, also on 11/26/18. OAG suspends license of Dr. Anzalone, NJ Green MD.

NJ DOH OK’d 6 applications for ATCs on 12/17/18 for Atlantic City, Elizabeth, Ewing, Paterson, Phillipsburg & Vineland. Lawsuits challenge awards, alleging fraud in one case and questioning the scoring methods overall.  MMP has over 40 K patients. OUD OK’d for marijuana therapy in conjunction with MAT. Dr. Elnahal continues outreach to NJ MDs.

CBS refused to air medical marijuana ad during Super Bowl.

NJ DOH MMP proposed regulations: CMMNJ awaits adoption of rules: our comments.

Approve February 2018 minutes. Discuss:

CMMNJ met with DOH Deputy Commissioner Jackie Cornell on 2/28/18 as part of Gov. Murphy’s Executive Order #6 to expand and improve access to the Medicinal Marijuana Program. CMMNJ urges extensive revisions to the MMP. "It was a program designed to keep people out of it," said Ken Wolski, in NJ.com. "It’s a program that’s not meeting the needs of the patients.” The Medicinal Marijuana Program (MMP) Review Panel said 43 petitions should be added to the MMP; the DOH must act by 4/25/18.

NJ Assembly Oversight, Reform and Federal Relations Committee: CMMNJ was invited to give oral and written testimony in support of legalizing, taxing and regulating marijuana for adults in NJ at the Trenton Statehouse on March 5, 2018. Follow up committee meetings planned for 4/21 @ 10 am at Rowan U., Glassboro, and 5/12 @10 am at Bergen C.C., Paramus.

Advocates speak up at local council meetings throughout the state in support of marijuana reform.

January 2018 minutes approved. Discussion:

Governor Phil Murphy signed Executive Order #6 to expand and improve access to the Medicinal Marijuana Program at a Press Conference in Trenton on 1/23/18. DOH & BME given 60 days to come up with new rules. "I'm very pleased the governor has taken such a strong stand to expand the program," Wolski said in NJ.com.

Trenton Cannabis Community meeting on 2/7/18 at Artworks in Trenton; discussion involved marijuana reform & breaking the stigma, voter registration & other local activity, getting patients into the medical program, preparing for the new industry. Follow up meeting planned for March 14th. 

NJ’s legalization bill re-introduced in new legislative session (S830 / A1348): Facebook’s “Friends of CMMNJ” letter template in support of home cultivation, addressing concerns.

The Medicinal Marijuana Program (MMP) Review Panel said 43 petitions should be added to the MMP; the DOH commissioner must act by 4/25/18. CMMNJ urges extensive amendments to CUMMA.

Governor-elect Phil Murphy reaffirms plans to legalize marijuana in the first 100 days of 2018! Who is contacting whom in the new Administration about moving forward with advances for patient access and decriminalization/expungement? Jim Miller working with Bill Caruso and he is willing to accompany any patient in legislative meetings; Ken working with Doctors for Cannabis Regulation; Peter & Bob Kane working with S. Jersey legislators; patients/advocates urged to contact individual legislators.

Gov. Christie finishes his second term at noon on Jan. 16.

CMMNJ held a Press Conference in the State House Annex on 12/7/17 where patients and advocates explained the need for home cultivation—keeps it affordable; guarantees strain specific availability, etc.

Expect marijuana use uptick of 3% with new law; 97% of current marijuana users will just change vendors from illegal market to legal market. Teen use down in legal states.

Senator Cory Booker introduced The Marijuana Justice Act of 2017 at a press conference in Linden, NJ on August 4, 2017.  CMMNJ members were invited guests. Supporters are looking for national co-sponsors of Booker’s bill—suggest Capwiz from NORML, DPA?

Princeton psychiatrist Dr. David Nathan gave a presentation at the August CMMNJ meeting on the organization he founded, Doctors for Cannabis Regulation, DFCR.org.

Here's what the legal pot bill would do
Scutari's bill, (S3195) based on visits to Colorado's thriving recreational program would:
Decriminalize marijuana possession of up to 50 grams "immediately" and allow people who have been arrested for pot possession to expunge their records.
Establish a Division of Marijuana Enforcement in the state Attorney General's Office which would create the rules used to govern the legal market of growers and sellers.
Allow people to possess up to one ounce of dried marijuana, 16 ounces of edible products infused with cannabis, 72 ounces in liquid form and seven grams of marijuana "concentrate."
Impose a sales tax on recreational sales beginning at 7 percent in the first year, climbing to 10 percent in the second year and jumping five percent more each year until it reaches 25 percent. Taxes on medical marijuana would be abolished.
Give the five existing medical marijuana dispensary nonprofit groups first crack at selling recreational pot.

Sen. Scutari introduced a legalization bill (S3195) on 5/15/17 at a State House press conference. CMMNJ issued a press release in support of the bill: "Legalization is the best way to get the right medicine to the most people." CMMNJ will call for CUMMA amendments—repeal 7% medical tax; add home cultivation; & reschedule marijuana. Informational hearing at Senate Judiciary Committee scheduled for 6/19/17.

NJ DOH Medicinal Marijuana Program Review Panel gave initial approval to 43 of 45 petitions to add conditions to the MMP (only Asthma and Chronic Fatigue denied). A 60 day public comment period to start soon(?), followed by final rec’s.  DOH Commissioner has 180 days to decide.
