NJ’s Medicinal Marijuana Program (MMP): Only Greenleaf ATC in Montclair, NJ is selling marijuana to registered patients who report 2 to 7 months wait for an appt. after receiving DOH ID card.  CMMNJ Press Conference is scheduled for 3/21/13 at noon in State House Annex.

Lymphoma patient Matt B. says he got his ID card in Oct. and finished chemo by Jan. with no medical marijuana.

TRENTON - The state Health Department on Thursday issued the following statement following criticisms from medical marijuana advocates about what they claim is the slow pace of the program's implementation. The department says the implementation of other alternative treatment centers (ATCs) is in the works.

Here is the statement from Health Department's communications manager Daniel Emmer:

"Gov. Christie has taken a responsible approach to administering medical marijuana for qualified New Jersey residents. Following the opening of the first medical marijuana dispensary, the Fiscal Year 2014 Budget proposal doubles funding for the program with an increase of $823,000 for a total of $1.6 million.

"Just this week, the Department informed Compassionate Care Foundation in Egg Harbor Twp. that it has approved the participation of several key board members and as well as its financial structure. The next step is for them to tell the program when they are ready for an inspection of their facility in order to get a permit to grow. (see attached letter)

"A third ATC—Compassionate Care Center of America in Woodbridge is very far along in the process. An examination of its principals and finances is ongoing.

"Two other ATCs have secured locations and examinations of their key board members are ongoing

"With the exception of Greenleaf, all ATCs have had a difficult time securing host communities. Greenleaf Compassion Center began serving patients in early December and the Department continues to work with them to increase patient access.

"To address physician education on the medicinal marijuana, the Medicinal Marijuana program has partnered with the New Jersey Board of Medical Examiners, the New Jersey Medical Society and the Drug Policy Alliance to provide informational webinars and an electronic library of scholarly articles and research materials.

"The (Health) Department is committed to ensuring ATCs are operated by responsible individuals who embrace our goals of timely safe and responsible access by patients."

MS Society Refuses Medical Marijuana Information

Imagine my surprise when I found out that the Coalition for Medical Marijuana--New Jersey (CMMNJ) had been invited to have a table at the Greater Delaware Valley MS Society's March 23rd "Beef and Beer" fundraiser.

I have been at odds with the National MS Society over their deliberate ignorance concerning the benefits of medical marijuana relative to MS symptoms since 1995. In 1997 Cheryl headed up the Cures Not Wars yearly May March down 5th Ave in Manhattan with a sign that said "MS Society's Dr. Reingold Lies About Medical Marijuana."

After the march, legal federal medical marijuana patient Elvy Musika accompanied us as we delivered the sign to the National MS Society's headquarters at 733 3rd Ave. Dr. Reingold chose not to come down to the lobby to accept it in person. He was the head of research and director of grants management for the MS Society at that time and he was doing everything that he could to see that marijuana was NOT clinically studied relative to MS, while at the same time marginalizing multiple sclerosis studies that had been done with THC. As more and more positive information about cannabis began emerging from the British and Canadian MS Societies, our National MS Society's Clinical Advisory Board had to start making certain stipulations such as, "Because inhaled smoked cannabis has more favorable pharmacokinetics than administration via oral or other routes, research should focus on the development of an inhaled mode of administration that gives results as close to smoked cannabis as possible." And, "There are sufficient data available to suggest that cannabiniods may have neuroprotective effects and that studies in this area should be aggressively pursued."

Although I have handed out medical marijuana information at MS Society walks and bike rides for 18 years, both with and without Cheryl, this would be my first time doing so by invitation. It seemed that we had indeed come a long way.

On Saturday, March 23, 2013 Cathi and I arrived at Heroes Hall FOP Lodge #5 on Caroline Road in N.E. Philadelphia, 40 minutes ahead of the 7:30 PM scheduled start of the fundraiser. We knew that there would be 250 attendees plunking down $40 apiece at the door before the actual fundraiser began. Although the night might prove to be financially beneficial for CMMNJ, the real reason that I was there was to interact with supporters who showed such commitment towards improving the lives of MS patients and their families. Statistically speaking, the vast majority would be glad to find out what they could do to help urge the MS Society to take a more active role in cannabis research relative to MS symptoms, and they would no doubt agree that two decades worth of saying that "we need more studies" without attempting to do those studies is no longer acceptable.

When fellow CMMNJ board member Nick Mellis arrived with our table material we all went in to set up. That is when "if it SEEMS too good to be true, it IS too good to be true" set in. As Nick was bringing the second tub of table material in we were told that "there is a problem with your table". It seems that that someone with ties to Clear Channel Outdoor (http://clearchanneloutdoor.com/about-us/) objected to medical marijuana information being available to MS patients and their families at the fundraiser, even if it originated from the MS Society itself, and they threatened to pull sponsorship from the event if we were allowed to set up.

This happened with plenty of time to inform us of the change, yet nobody bothered to notify anyone at CMMNJ. They left two extremely chagrined MS Society volunteers who supported us being there, to tell us to go home when we arrived. Against my initial instinct to react, I opted for leaving on the high road handed to us, and evaluating potential repercussions for that decision that would not be reactionary and immediate, but rather well thought out and planned with an end goal in mind all of the way.

A coalition of lawmakers, physicians and patient advocates are demanding prompt improvements to New Jersey's 3-year-old Medical Marijuana law.  They will discuss the importance of this program to the thousands of sick and dying residents in NJ and their caretakers.

"NJ's medical marijuana program is not where it should be three years into its implementation," said Patient/Activist Jay Lassiter who uses medical cannabis to treat symptoms associated with HIV treatment.  "It's over-regulated, over-taxed and inaccessible, especially for terminally ill patients who live in the Southern 2/3 of the state.  It's hard to imagine the State Government running any program so incompetently. New Jersey's Medical Marijuana represents Big Government at its worst."

"The opening of the Greenleaf Compassion Center is a much welcomed sign in this long-sought progress for the patients who have been waiting for this program to become reality,” said the law’s prime sponsor Assemblyman Reed Gusciora (D-Mercer.)  “However, this program will only be successful if all patients throughout our state have reasonable access to this treatment, so it’s crucial to see more progress on the additional five locations that should be opened by law.”

"My philosophy on New Jersey's medical marijuana law is that we should be empowering doctors to treat their patients as they see fit, and not have lawyers or bureaucrats standing in the way.  That why I'm frustrated at the State's implementation of this law, which smacks of big-government overreach,” observed Assemblyman Michael Patrick Carroll (R-Morris.)  “I concluded long ago that burdensome regulations are bad for business and a threat to our liberties. New Jersey's clumsy, hyper-bureaucratic roll-out of its medical marijuana law only affirms that belief.”

Monthly Public Meeting Minutes

January 8, 2013

7:00 PM:  Meeting called to order.   December 2012 minutes approved.  Discussion:

Reminder: There will be no public CMMNJ meeting in February; library room unavailable.

NJ’s Medicinal Marijuana Program (MMP): Greenleaf ATC in Montclair, NJ is selling up to ½ ounce of marijuana to registered patients by appointment only--at least two months wait for an appointment.  Two strains are available; a sativa and an indica (Green Crack & Blue Dream). THC content reportedly exceeds 10%.  NJ’s 7% sales tax applies—cost is approx. $130/quarter ounce. Fewer than 500 patients have ID cards from DOH.  Rumors are that improvements to the MMP will be coming soon, including the promised lozenges.  MMP is failing hospice patients and many others.  Some oncologists in the state admit knowing marijuana helps cancer patients but refuse to join DOH registry (along with 99.5% of all NJ MDs.)

The lawsuit against DOH for failure to meaningfully implement the MMP is progressing and it asks the court to appoint CMMNJ monitor of the program. (A court hearing was held 1/24/13.)

The cmmnj.org web site crashed.  Ryan Bly fixed it; discussion re: need for continuous update.

NJ.COM LTE: Medical marijuana a safer option

In her letter “Medical marijuana: The end doesn’t justify the means” (Jan. 24), Assemblywoman Mary Pat Angelini (R-Ocean) paints a fear-mongering picture of medical marijuana as a gateway drug.

Ms. Angelini claims to be “sensitive to the pain that individuals endure from disease,” but her letter proves otherwise. Calling marijuana a “highly dangerous drug” in the context of medical use is ridiculous. A quick glance at the side effects of the arsenal of drugs legally prescribed for my cancer yields the following warnings: “euphoria, feeling of being ‘high,’ tolerance, risk for dependency,” not to mention “weak or shallow breathing, confusion, double vision, nausea, dizziness, seizure, liver toxicity, cardiac arrhythmia, heart attack, coma, death.” I invite Ms. Angelini to look me in the eye and tell me medical marijuana use — or “abuse” — is anywhere near as dangerous as that.

As a cancer patient, I have taken a multitude of prescription drugs. When combined with the toxicity of chemotherapy drugs, the effects on my body were devastating. I have been hospitalized for side effects of these medications, and have had to wean myself off of them slowly, under a doctor’s supervision, to avoid life-threatening withdrawal symptoms. I am thankful every day that I did not develop a full-blown addiction to these pharmaceuticals, but many patients are not so fortunate.

Surely, through her work as a substance abuse program director, Ms. Angelini must realize that prescription drug dependency is a true problem for people who have had serious illnesses or injuries, and that prescription opioid abuse is a real gateway to hard drug addiction.

Medical marijuana does not pose any proven health risks, and it offers not only pain relief, but may even provide actual treatment for certain diseases.

Sen. Scutari’s bill, S1977 (to decriminalize 50 grams of marijuana), is not yet scheduled for a committee hearing.  Find community support--outreach to HIV/disability/hospice community.

Monthly Public Meeting Minutes

December 11, 2012  

7:00 PM:  Meeting called to order.   November 2012 minutes approved.  Discussion:

12/6/12 was “Legalization Day” per the Associated Press.  Washington State’s marijuana legalization law went into effect and, coincidentally, Greenleaf ATC in Montclair, NJ sold ½ ounce of marijuana to 20 patients to start NJ’s Medicinal Marijuana Program.  NJ’s 7% sales tax applied to medical marijuana sales.  The Trenton Times, the Philadelphia Inquirer, and the Newark Star Ledger all agreed with CMMNJ that the tax was wrong.  

CMMNJ still sees the MMP as a failure—failing the vast majority of patients in the state who could benefit from it.  Tens of thousands of qualified  patients die every year without getting legal access to marijuana.  Also, if MD’s can recommend drugs off-label, why can’t they do so with marijuana? The lawsuit against DOH for failure to implement the state’s MMP is progressing and it asks the court to appoint CMMNJ monitor of the program. Court hearing is expected 1/17/13.
