This is a free, open, non-judgmental space for individuals to express their opinions and thoughts on current events and issues on medical marijuana.

Agenda: New Jersey Issues

NJ recreational marijuana sales reached $117.47 million in September, a 23.1% increase from last year. The state’s 2026 total above $1 billion. Also, there is growth among smaller marijuana businesses and the state’s social equity program. Almost $200 million in total taxes have been collected so far.

Senate Bill S4685, would prohibit law enforcement officers, first responders, drivers with a CDL, and operators of heavy equipment from using cannabis recreationally, whether on or off duty. No hearings scheduled yet.

Senate bill S4287 sponsored by Senate President Scutari, D-Union, and Senate Minority Leader Bucco, R-Morris, would create specific criminal penalties for an unlicensed cannabis retail business, with fines ranging from $10,000 to $50,000. It was released from the SJU on 10/15/26.

Democracy depends on public deliberation, and Scutari’s control of the Senate agenda routinely cuts it short.

The Brick Township council voted 6-1 to permit the sale of marijuana in town. “You have the opportunity to learn, and as you learn, you can change your mind.”

Sativa Cross got a meeting with the governor's Office of Constituent Relations re: Home Grow. We await more details and follow up.

The NJ Legislature approved Senate Bill 4635 extending the deadline for licensed businesses to sell intoxicating hemp beverages, sending the measure to Governor Mikie Sherrill. Certain businesses are allowed to sell intoxicating hemp beverages until November 13. Without additional legislation, those businesses would face new restrictions beginning November 14.

Realm of Caring: The Problem Is Not That Cannabis Is Absent From Patients’ Lives; It is often absent from their care plans.

“Am I a candidate for magic mushrooms?”

On 9/25/26, NJ AG said three synthetic Kratom related substances – mitragynine pseudoindoxyl (MP), MGM-15, and MGM-16 are now illegal to possess in NJ. A federal order places these substances under Schedule I of the CSA through 8/26/28. Kratom (the natural leaf), standard mitragynine, and concentrated synthetic 7-hydroxymitragynine (7-OH) are not included in this action.

NJ Nurses support medicinal cannabis bills. The New Jersey State Nurses Association (NJSNA) confirmed their continuing support for the following bills:

  • S4023: Allows costs of medical cannabis to be reimbursed by Catastrophic Illness in Children Relief Fund, PAAD, Senior Gold and VCCO.
  • A1023/S3984: Requires workers' compensation, PIP, and health insurance coverage for the medical use of cannabis under certain circumstances.
  • S1792: Establishes program to subsidize purchase price of medical cannabis for registered patients enrolled in Medicaid or NJ FamilyCare programs.
  • S1758/A1674: Permits home cultivation of up to four mature and four immature cannabis plants for patients who are in the state’s Medicinal Cannabis Program.

New Jersey Hospital Association: What action can the NJHA take to coordinate the integration of medicinal cannabis into the Controlled Substances polices of New Jersey’s healthcare facilities? Letter sent to NJHA. I also informed the NJHA about the NJSNA’s support for the medicinal cannabis bills.

Current NJ status: Criminal offense for growing any cannabis plants:

    • 1-10 plants: 3-5 years in prison, up to $25,000 fine;
    • 10-49 plants: 5-10 years in prison, up to $150,000 fine;
    • 50+ plants: up to 20 years prison, & $300,000 fine.

MPP: All but three of the other 23 legalization states allow home cultivation! Tell your lawmakers to support S2564/A4576: legalizes growing up to six marijuana plants for personal recreational use, and up to 10 plants for personal medical use, by persons aged 21 or older.

MoveOn: Legalize Cannabis Home Grow in the state of New Jersey.

Open Letter to Governor Sherrill: please issue a Moratorium on arrests for small medical gardens of cannabis in New Jersey.

The DEA has generated $12.3 million in federal registration fees from nearly 7,000 medical marijuana business applications. Manufacturers account for the largest share, despite dispensaries representing most applications. CFR link.

The DEA granted hundreds of federal registrations to state-licensed medical marijuana dispensaries under the Attorney General’s order implementing Schedule III controls for certain medical marijuana activities. The 900 federal medical cannabis registrations might be like licenses. ASA’s Steph Sherer said,

“Thirty years ago, patients turned to the states because Washington refused to recognize their medicine. Washington is recognizing the very programs those patients built. As we approach the 30th anniversary of California’s Proposition 215, it is hard to imagine a more powerful demonstration of how far patient advocacy has brought us.”

The DEA filed a brief urging a federal ALJ to give no weight to a recent GAO report identifying deficiencies in federal drug-scheduling procedures. More soon.
